For condo owners along the gulf coast who lost rental income
this summer because of the BP Deepwater Horizon oil spill, time is running out
to file a claim for emergency payments. Speaking to residents and condo owners
in Gulf Shores and Orange Beach in late August, Ken Feinberg, the Washington
attorney in charge of paying claims from the from the Gulf Coast Claims
Facility (GCCF), said claimants have until Nov. 23 to file an emergency payment claim with
his office.
GCCF took over the claims process from BP on Aug. 23.
Feinberg said those who do not file a claim by Nov. 23 are not totally shut out
of receiving a payment from the $20 billion fund created by BP, but no claims
for an “emergency payment” will be entertained after that date. He went on to
say that claimants who file their initial claim after Nov. 23 remain eligible
for a “final payment” from the fund.
When pressed on details about the “final payment” claims,
Feinberg declined to provide very many. “Right now, we’re not focused on final
payments,” he said. “We’re focused on emergency payments.” However, he did say
that once a check for a final payment is paid out, the claimant would forfeit
the ability to sue for those damages at a later date.
Feinberg said the goal of GCCF was to pay out individual
claims within 48 hours of filing and business claims within seven days of
filing. This ambitious goal was welcome news to claimants who often had to wait
weeks and, in some instances, months before receiving compensation from BP. |
